This research addresses the patient's right to compensation for moral damage resulting from medical malpractice under Omani legislation, as it is considered one of the important legal topics whose significance has increased with the development of healthcare services and the growing number of medical liability cases.This study aims to achieve several objectives, the most significant of which are to clarify the concept of moral damage within the scope of medical liability, identify the legal basis for a patient's right to compensation for such damage under Omani legislation, and examine the judge's discretionary authority in assessing compensation for moral damage and the criteria upon which such assessment is based.

This research addresses the patient’s right to compensation for moral damage resulting from medical malpractice under Omani legislation, as it is considered one of the important legal topics whose significance has increased with the development of healthcare services and the growing number of medical liability cases. The effects of medical malpractice are not limited to material damage only. Still, they may also extend to moral damage, which raises several legal issues concerning the legal basis for compensation and the mechanism for assessing such damage.
This study aims to achieve several objectives, the most significant of which are to clarify the concept of moral damage within the scope of medical liability, identify the legal basis for a patient's right to compensation for such damage under Omani legislation, and examine the judge's discretionary authority in assessing compensation for moral damage and the criteria upon which such assessment is based. The research problem lies in the inadequacy of the criteria governing the assessment of compensation for moral damage resulting from medical malpractice under Omani legislation, whether in the general provisions of the Civil Transactions Law or in the legislation regulating the medical profession. This inadequacy gives rise to difficulties in defining the concept of moral damage, determining the conditions for entitlement to compensation, and establishing the judicial standards for assessing such compensation.
