6 PART 2: COMPENSATION FOR THE SIGNIFICANT EMPLOYER DELAY IN DESIGN PHASE 6.1 NARRATIVE A. Study Phase 1.This request considers that the Landscaping works was defined in the TOR as a provisional Sum item, and the same was defined later in the Consultancy Agreement.no. QBT/TB/2/20593, dated 03rd Jun 2015 (Appendix 2 - Attachment No.6), ADM clarified that the landscaping and irrigation works includes: o Planting and landscaping the median in the dual road.no. QBT/TB/1/258, dated 06th Apr 2015, ADM provided conditional approval for the Study Phase report regarding road design, traffic study, asphalt payment, street lighting, stormwater drainage, and request DIWI to submit geotechnical study in the next stage.With letter ref no. QDM/AM/4/16/26403, dated 14th December 2014, ADM issued an Awarding letter to DIWI for the Consultancy Services including the Design Works with a duration of Six (6) Months, starting from 16th Dec 2014.no. QBT/TB/3859, dated 23rd Mar 2015, ADM approved the Study Phase report regarding the lighting and stormwater drainage.(Appendix 2 - Attachment No.1).With letter ref.2.3.4.5.6.7.8.

6 PART 2: COMPENSATION FOR THE SIGNIFICANT EMPLOYER DELAY IN DESIGN PHASE
6.1 NARRATIVE
A. Study Phase

1. With letter ref no. QDM/AM/4/16/26403, dated 14th December 2014, ADM issued an Awarding letter to DIWI for the Consultancy Services including the Design Works with a duration of Six (6) Months, starting from 16th Dec 2014. As per the Awarding letter, the completion date of the Design Works was on 16th Jun 2015. (Appendix 2 - Attachment No.1).


2. Based on the above Awarding letter, DIWI started the Study Phase under ADM instructions and advice that the Consultancy Agreement will be issued in a short time. However, the Agreement was issued very late by 17th Jun 2015 (delay of 6 months) and after the original completion date of the Design Phase on 16th Jun 2015 mentioned above.


3. With letter ref. DIWI-M-1407-E-L-0031, dated 01st Mar 2015, DIWI submitted study Phase report to ADM for review and approval. (Appendix 2 - Attachment No.2).


4. With letter ref. no. QBT/TB/3859, dated 23rd Mar 2015, ADM approved the Study Phase report regarding the lighting and stormwater drainage. (Appendix 2 - Attachment No.3).


5. With letter ref. no. QBT/TB/1/258, dated 06th Apr 2015, ADM provided conditional approval for the Study Phase report regarding road design, traffic study, asphalt payment, street lighting, stormwater drainage, and request DIWI to submit geotechnical study in the next stage. (Appendix 2 - Attachment No.4).




7. With letter reference no. DIWI-M-1407-E-L-0037, dated 5th Apr 2015, DIWI requested ADM to clarify the landscaping scope of works. This request considers that the Landscaping works was defined in the TOR as a provisional Sum item, and the same was defined later in the Consultancy Agreement. This item was also not detailed in the Study Phase report by ADM letter ref. letter no. QBT/TB/2/3859, and had no specific duration defined in the TOR, Awarding letter, nor later the Consultancy Agreement. (Appendix 2 - Attachment No.5).


8. With letter ref. no. QBT/TB/2/20593, dated 03rd Jun 2015 (Appendix 2 - Attachment No.6), ADM clarified that the landscaping and irrigation works includes:
