- Excluded Risks in Property Insurance:
These are mentioned in Articles 35 and 39 of Order 07-95.
Article 35 of Order 07-95 states: "The insurer is not liable for property that is damaged, lost, or destroyed due to:
• a) Insufficient or poor packaging by the insured.
• b) An inherent defect in the insured object, unless otherwise agreed."
Article 39 of Order 07-95 states: "The insurer is not liable for losses and damages caused by foreign wars unless otherwise agreed. The burden of proof for damage resulting from a foreign war lies with the insurer."
Thus, excluded risks can be divided into two categories: absolutely excluded risks and risks excluded unless otherwise agreed.
